Ex-police officer, so you're not up-to-date with the law and despite being in the trade, unable to confirm either point of view. So helpful.

As I though a film flam man and not willing to give an answer so I can only assume you are a politician and a poor one at that. . Your credibility is nil. Now as I said that it does not matter as the whole subject is trivial and more important miscarriages of justice and humanity are happening in the world. Now as a final thought on this subject I believe that everyone should bring something to a conversation. You should bring silence as you are looking like a fool and people are laughing at you. Take care now.

No one has yet proved me wrong, nor is Redrobo proven wrong. Shame about Doonhammer quitting without providing evidence either way.

If DH is still around, question to the expert. Can someone be fined by the police if they are not wearing a seatbelt when

a) they are on private property
b) it is reported by a member of the public
c) it is photographed by a member of the public.

I think it's about time someone stood up for Popcorn here. Firstly, he is not saying Phil the Greek should not have been prosecuted for not wearing a seatbelt, merely that a photograph taken by a member of the public, whose location cannot be verified, and may even have been photoshopped, cannot be used as sufficient evidence by the police to mount a prosecution, and that the same rules would apply to you and me. Is that clear, or is the mud still too thick?

None story. Regarding the seatbelt issue, he was on a public road but the police dealt with it how they would anyone. All the reports said he was on a public road so there's no reason to just assume he was actually on private land. As the photo doesn't provide evidence either way then all the police can do is advise him.
But yes, if you're on private property you can do what you like, drive boozed up if you wish.

Driving out of a junction into moving traffic however, that wasn't so smart.

He was on the public highway when the accident occurred; no one (except the photographer) knows where he was when the photo was taken.

His initial response was unnecessarily rude to RR, and it had wrong information , saying he had the accident on private land, he should be man enough to say sorry, and move on.....(with his seatbelt fastened).

50-50. I did say it was on private land, that's the only photo I'd seen at the time but RR went on to make a point that he'd been treated differently to you & I and my reply was targeted at that. Doesn't matter where the photo was taken, not enough evidence to charge him, just as they'd do to you & me.

Wonder if anybody on the forum has been prosecuted for driving without a seat belt?

I know of at least a couple who I used to work with who had been prosecuted for driving on the M6 without a seat belt and received a right bollocking from the boss (and myself) as like me they relied on their car for the company to do business.

I was a few years back. Only went from Regent Road to the Battery (Doctors) and I saw the blue flashing light to pull in.

I think it was a £50 fine. Had to blow in the bag but I don't drink so no problem.
